Terms and Conditions

• General Provisions
  • These Terms and Conditions are intended to regulate your use of (“the User”) the VšĮ “DARNAUS VYSTYMO PROJEKTAI“, legal entity code 300855721, registered office address is at Naujoji st. 23, LT-18124 Švenčionys, ​Republic of Lithuania (“Gifted”) platform (“Platform”) available at website https://platformgifted.eu/ (“Website”).
  • If the User does not agree to comply with these Terms and Conditions, he does not have a right to create a personal account and use the Platform.
  • By registering on the Website, the User expresses his consent to use the Platform, and to comply with all the terms and conditions set forth in these Terms and Conditions and any subsequent amendments and additions that Gifted may unilaterally effect from time to time by announcing it on the Website and (or) informing the User personally by e-mail.
  • Gifted assumes no risk or liability and is unconditionally released from it if the User has not fully or partially abided by these Terms and Conditions. Also, if the user has violated these Terms and Conditions.
  • By registering on the Website, the User confirms that he is at least 16 years of age.
• Personal Account
  • In order to create a personal account, the User has to fill out the Website registration form.
  • The User may only have one personal account.
  • The User publishes informational material at his discretion on the Platform.
  • The User undertakes to ensure the confidentiality of the personal account login data and not to disclose it to third parties and to ensure that no third parties will use their personal account.
  • Gifted indicates that in order to safeguard the legitimate interests and (or) prevent the User’s attempts to harm Gifted services, it has the right, unilaterally, at its sole discretion, without notice to the User to suspend the provision of the services to him and to cancel his personal account and delete the data contained therein.
• User Rights and Obligations
  • The User has the following rights:
    • to use the Platform in accordance with these Terms and Conditions;
    • to receive methodological assistance, consultations related to the use of the Platform;
    • to choose the desired courses and receive educational materials;
    • to get an electronic certificate after completing the course and leaving feedback;
    • to subscribe or unsubscribe newsletters;
    • to delete his personal account and the data contained therein.
  • The User has the following responsibilities:
    • to provide only correct and authentic information on the Website and Platform;
    • to use the Platform for legitimate purposes only;
    • not to copy and share presentations on the Platform;
    • not to transfer to third parties or provide access to a personal account;
    • to use the Platform responsibly, not to abuse his rights under these Terms and Conditions.
• Gifted’s Rights and Obligations
  • Gifted has the following rights:
    • to share the information posted by the User on the Platform at its discretion;
    • to prevent users who using the Platform to refuse to comply with or violate these Terms and Conditions;
    • to handle the User personal data for legal and predetermined purposes;
    • to take immediate site-based security measures, including, but not limited to, the suspension or termination of the provision of the Platform, the limitation of the availability of the services to specific site visitors if there is any reasonable threat to the safety of the Platform’s data, hardware or software (for example, in the case of cyber-attacks, etc.).
  • Gifted has the following responsibilities:
    • to implement the Platform information security management system organizational and technical measures to ensure the reliability, accuracy and identity of the data and to protect the data against accidental or unlawful destruction, modification, disclosure, as well as any other unlawful handling, from the moment when the User’s personal data is submitted to the Platform until the expiry of the storage period for such data.
• Protection of Users’ personal data
  • To provide the services, Gifted manages the Users’ personal data in accordance with the Privacy Policy, which is an integral part of these Terms and Conditions.
• Settlement of disputes
  • All disputes arising from these Terms and Conditions are resolved through negotiations. If the parties do not agree within 14 calendar days after the beginning of the dispute, the disputes shall be dealt with in accordance with the laws of the Republic of Lithuania.
• Final provisions
  • If the User does not agree with the revision of the new Terms and Conditions, its partial amendments or additions, the User has the right to refuse them, as a result losing the right to use the Platform.
  • If, after the change of the Terms and Conditions, the User continues to use the Platform, it is deemed that he accepts the revision of the new Terms and Conditions, amendments or additions to the new Terms and Conditions.

These Terms and Conditions are effective from 1 September 2022.
